Subject

These conditions of sale are concluded between the individual company Christophe THIRION, Passion-Miniatures, whose head office is located at 34 route de Juzanvigny – 10500 Brienne le Château – France, registered in the Troyes Trade and Companies Register under number 833 742 166, hereinafter referred to as “the seller” and, any natural or legal person referred to hereinafter as “the buyer”. The acquisition of a product on the website implies unreserved acceptance by the buyer of these conditions of sale, which he acknowledges having read before placing the order.
The applicable conditions of sale will be those in force on the date of order by the buyer. the seller can change these conditions of sale in order to comply with legislation and market rules.

Products

the seller offers second-hand products mainly from individuals. They are sold as is without any warranty. However, these products are subject to verification, cleaning or revision. Each product is presented with a description of its main characteristics. The dimensions displayed are an approximate indication of the product allowing the buyer to get an idea of ​​it. The photos are as accurate as possible but do not commit the seller in any way.

Product assortment and stock vary depending on the second-hand market. These products are in principle no longer produced.

The buyer will ensure that the product he is having delivered to a country other than France is authorized to enter this territory.

Prices and billings

The prices appearing on the product sheets are entered in Euros. They may be displayed in one of the other currencies available on the site depending on the configuration of your browser. In this case the prices displayed may vary depending on the current exchange rate.
The prices indicated do not include shipping costs which will be added to the total price of the products purchased.
Prices may be changed at any time. Only validation of the order by the buyer guarantees the final price of the products requested.
The seller is a microenterprise not subject to VAT in accordance with article 293B of the General Tax Code.
Invoices will be drawn up in the language used by the buyer during order validation. Prices will be written only in euros regardless of the payment currency used.
For countries outside the European Union: Import taxes may be requested when the package enters the destination country. Passion-Miniatures does not manage these taxes, the buyer must inquire with the customs of their country before placing an order.

Control

The buyer has the possibility of creating a personal account on the site. This allows you to follow the progress of the order and manage your profile. The buyer can delete or modify his account at any time.

The buyer can place an order without creating an account on the site. In this case he will not be able to follow the order other than by exchanging emails.

Shipping costs are calculated after validation of the order by the buyer. This validation does not commit the buyer to payment but only constitutes a reservation of the products.

After accepting the order and verifying that the delivery address is correct, the buyer proceeds to payment. All the data provided and the recorded confirmation will constitute proof of the transaction.

If within 10 days following validation of the order the buyer does not make payment or does not follow up, the order will be canceled and the products made available.

Payment terms

Payment for the order is made in the selected currency with one of the following payment methods:

Payment by check
Only checks issued by a French bank will be accepted. Checks will be made payable to Christophe THIRION. The buyer will send his check with the order form in a stamped envelope to the address of the company's head office. Upon receipt of the check, the order will be processed and the buyer will be informed by email. The seller will ship the products after cashing the check corresponding to the order, subject to provisions.

Payment by bank transfer
The seller's bank details are communicated to the buyer when confirming the order.
The buyer contacts his bank to make the transfer corresponding to the amount of his order. Upon receipt of the transfer, the order will be processed and the buyer will be informed by e-mail. The seller will ship the products after receipt of the transfer to his account.

Payment by credit card
Payment by credit card is made using the secure online payment service Stripe Express.

Payment by Paypal
The buyer is redirected to the Paypal interface to connect securely and make the payment. If payment is accepted, the order is saved. The seller will ship the products after payment is confirmed by Paypal.Other payment methods

Shipping

Orders are shipped to the address specified by the buyer. Delivery times are given for information purposes only. Transport risks are the responsibility of the seller. The buyer is required to check the condition of the package and must file a claim with the seller in the event of damage.

For deliveries to relay points, the customer is informed of the tracking of their delivery. The customer is required to collect the package before the expiration of the holding period at the relay point.

If the package is returned to the seller because of an incorrect address communicated by the buyer or the package has not been collected before the end of the retention period at the relay point, the customer will have to pay the amount of a re-dispatch. The customer may cancel the order but shipping costs will not be refunded.

Unclaimed products are kept for 1 year. If the customer does not appear during this period, the order will be canceled and not refunded. The products will be put back on sale.

Withdrawal from Brienne le Château

The seller offers to hand deliver the order. The buyer has the possibility of picking up the order in the Brienne le Château area. The buyer and seller must agree on a common meeting place.

In accordance with article L221-18 of the Consumer Code, the buyer has a period of 14 days from receipt of the order to exercise their right of withdrawal. Return costs are the responsibility of the buyer. The seller will reimburse without penalty upon receipt of the products.

Claim

If the order arrives damaged or if a delivery error is noted, the buyer is invited to contact the seller using the contact details indicated on the order form. Email is preferred.

If the liability of the carrier is engaged, a claim will be opened with the carrier by the seller. The seller undertakes to replace or refund the order and will cover the return costs.

Warranty

The products offered by the seller are second-hand. There is no guarantee possible on these products. In the event of a defect, the buyer may make a claim. The seller cannot be held responsible for hidden defects. Where possible, products are checked and a statement indicates whether the product works or whether it could not be tested.

Liability

The seller in the distance selling process is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.
